Danish Court Allows TV 2 to Remove Veil in Documentary

TV 2 has been granted permission by the appeals court to remove the blur on a legal advisor in the documentary “The Black Swan,” which deals with organized crime. The legal advisor, Juliett Kapello, has been anonymized due to a pending case, but the appeals court has overturned the district court’s decision, which deemed that revealing her identity would be too intrusive into her privacy. The court justifies its decision by stating that the recordings are of significant public interest.

Editor-in-chief Michael Nørgaard from TV 2 Documentaries expresses great satisfaction with the decision and emphasizes that the station believed that the district court’s earlier ruling was a misguided interference with the media’s freedom of information and expression. Therefore, TV 2 chose to bring the case to the appeals court immediately.

The documentary “The Black Swan” focuses on various aspects of organized crime and includes recordings in which Juliett Kapello talks about the possibility of opening a residence for people with autism with municipal funding. In one recording, she mentions that “we can get 300,000 for autists per person,” which she describes as “clean money, which holds so much value.” Kapello has refused to participate in an interview but has stated over the phone to TV 2 that her comments in the documentary were just talk and not something she actually intended to pursue.

The documentary has already had significant consequences for several individuals involved. Lawyer Nicolai Dyhr, a former partner at the law firm Horten, has been fired and is now being investigated by the Danish Bar and Law Society. Additionally, the Danish Tax Agency has decided to reopen at least 16 bankruptcy cases in which Dyhr was the trustee. Another lawyer, Lise Roulund, is also under investigation by the Danish Bar and Law Society and has been reported to the police based on her statements in the documentary.
