A court case in Lyngby will determine whether a landlord can be held responsible for an accident that occurred in Charlottenlund during Storm Malik two and a half years ago. A tragic incident at the end of January 2022 led to two large beech trees falling on a property in Charlottenlund, one of which fell into the building. At the time, three children were inside on the first floor, with the youngest, a five-year-old, sustaining serious injuries. The child experienced a complicated skull fracture and dangerous bleeding under the brain’s meninges, as detailed in the police indictment.
The landlord of the property and his contact person are now accused of negligently causing the child’s injuries by failing to cut down the old and fungus-infested beech trees, which had a high risk of falling. Despite having been warned about the danger, they allegedly did not take the necessary precautions, leading to this unusual court case. The two defendants deny the charges, but if convicted, they risk being imposed a fine.
The trial is set to resume with a court hearing on August 13, where the judge will decide if the defendants have violated criminal law. The accident, reported by the local media outlet sn.dk, involved a family living on Krathusvej with three children aged 13, 9, and 5. The five-year-old who was seriously injured has received the most attention in the proceedings.
