US Supreme Court Allows Trump’s Sentencing to Proceed in New York

The United States Supreme Court has decided not to halt Donald Trump’s upcoming sentencing in his case in New York, where he has been convicted on serious charges concerning hush money paid to a pornographic actress. The justices also rejected a related request to lift a gag order until after the upcoming presidential election.

The decision, made on Monday, responds to a lawsuit filed by the state of Missouri. This case asserts that the charges against Trump violate voters’ rights under the U.S. Constitution to hear from the Republican presidential candidate as he seeks to regain the presidency. The Supreme Court’s order was not signed. Conservative justices Clarence Thomas and Samuel Alito indicated that they would have allowed Missouri’s Attorney General Andrew Bailey to file the lawsuit, but they would not accommodate his request to quickly lift the gag order and postpone the sentencing hearing.

Bailey argued that the gag order in New York, which Missouri sought to suspend until after the election, improperly restricts what the GOP candidate can say while campaigning across the country. He emphasized that Trump’s upcoming sentencing could affect his ability to campaign. “The actions from New York have caused constitutional harms that threaten to infringe upon the rights of voters and those elected in Missouri,” he wrote.

New York’s Democratic Attorney General Letitia James contended that appeals are already underway in the state’s courts and that there is no conflict between the states that would give the Supreme Court reason to intervene at this time. “Allowing Missouri to file this lawsuit against New York would permit an extraordinary and dangerous circumvention of the ongoing state processes against the former president,” she stated.

Trump was found guilty in May of falsifying business records to conceal a $130,000 payment to pornographic actress Stormy Daniels. The payment was intended to ensure she did not speak about an alleged sexual encounter with Trump prior to the 2016 presidential election. Prosecutors have claimed that the payment was designed to bolster his presidential campaign in 2016, during which he defeated Democrat Hillary Clinton. Trump, the Republican nominee in this year’s election, denies having had sex with Daniels and has pledged to appeal his conviction after the sentencing, which is scheduled for September.

He is also seeking to overturn the conviction, citing the Supreme Court’s ruling from July, which granted him broad immunity from prosecution as a former president. This decision effectively ended the possibility of him facing trial over charges of election interference in Washington prior to the election. The Supreme Court has previously rejected similar cases filed as interstate conflicts in recent years, including cases related to the results of the 2020 presidential election.
