British fraudster Guenther Klar might receive a lighter sentence in Denmark

When the Eastern High Court (Østre Landsret) is scheduled to determine the sentence for the British fraudster Guenther Klar in January, he may be looking at a more lenient punishment. The court in Glostrup sentenced him to six years in prison in February for his involvement in a fraud scheme related to dividend tax in Denmark. However, because he has also been convicted in Belgium for similar crimes, his total sentence is likely to be shorter.

Guenther Klar is behind extensive fraud against both Danish and Belgian tax authorities. In Belgium, he managed to draw approximately 80 million Danish kroner (around 11 million USD) from the state treasury, while he defrauded the Danish authorities for a total of 320 million Danish kroner (around 46 million USD). The Belgian ruling was made in April 2023, where Klar received a four-year prison term, but the sentence only became final after he dropped his appeal in Belgium.

The principles of moderated cumulation and concurrent sentencing mean that the Eastern High Court will take into account the Belgian sentence when determining Klar’s punishment in Denmark. In simple terms, this means that the court will provide an overall assessment of the penalty for his crimes and will then deduct the four years he has already been sentenced to in Belgium. Consequently, the total sentence will only be lengthened if his crimes justify a significantly longer punishment.

Klar has appealed the Glostrup ruling, initially hoping for an acquittal, but the appeal now solely concerns the sentencing. His defense attorney, Katrine Gottlieb, explains that if the Danish and Belgian cases had been dealt with simultaneously, Klar would have received a consolidated sentence instead of two separate ones.

The prosecution agrees that an additional penalty should be imposed, but the length of this penalty will be subject to discussion in the Eastern High Court. Currently, Gottlieb has approached the Supreme Court (Højesteret) to assess whether it is proportional to keep Klar in pre-trial detention until the appeal hearing in January.

In addition to his criminal activities in Belgium and Denmark, Guenther Klar has also been involved in the notorious Sanjay Shah case and led the firm Salgado Capital. The company was implicated in manipulating documents that led the Danish tax authorities to disburse large sums in unjustified dividend tax payments.

The case of Guenther Klar is complex, involving international ramifications, and it is set to find its final resolution in the Danish courts. It will be interesting to observe how the Eastern High Court weighs the Belgian ruling in December.
